Haha Moment LLC operates multiple software products. Your use of a specific product may be subject to Supplemental Terms (e.g., a SaaS Subscription Agreement or End User License Agreement).

In the event of a conflict between these General Terms and the Supplemental Terms for a specific product, the Supplemental Terms shall control with respect to that specific product.

5. User Accounts

6. User Generated Content & AI

Our Services may allow you to post, store, share, or generate content ("User Content").

• Ownership: You retain ownership of any User Content you submit or generate.
• License to Us: By providing User Content, you grant Haha Moment LLC a worldwide, non-exclusive, royalty-free, perpetual license to use, reproduce, modify, display, and distribute such content in connection with the Service.
• AI Disclaimer: You acknowledge that content generated by Artificial Intelligence (AI) may be inaccurate, offensive, or nonsensical. Haha Moment LLC makes no warranties regarding the accuracy or reliability of AI-generated outputs.

7. Intellectual Property

The Services and their original content (excluding User Content), features, and functionality are and will remain the exclusive property of Haha Moment LLC and its licensors. Our trademarks and trade dress may not be used in connection with any product or service without the prior written consent of Haha Moment LLC.

8. Prohibited Uses

You agree not to do any of the following:

• Use the Services in any way that violates any applicable federal, state, local, or international law.
• Attempt to reverse engineer any software used to provide the Services.
• Use the Services to generate or disseminate content that is harassing, defamatory, or hateful.
• Interfere with, or attempt to interfere with, the access of any user, host, or network.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HAHA MOMENT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICES; OR (C) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

10. Dispute Resolution

Governing Law: These Terms shall be governed by the laws of the State of California, without respect to its conflict of laws principles.

Arbitration: Any dispute arising from these Terms or your use of the Services shall be resolved through binding arbitration in San Francisco, California, administered by the American Arbitration Association (AAA). You agree to waive any right to a jury trial or to participate in a class action.

We reserve the right to modify these Terms at any time. If we make material changes, we will provide notice through our Services or by other means. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.
